These Terms of Use govern your use of the Watermark Design Build website and our client and trade partner portal. By using the site or signing in to the portal, you agree to these terms. If you do not agree, please do not use the site.
What this site is
Our website provides information about our design-build services, project examples and general guidance. The portal gives homeowners and trade partners access to the records connected to their own projects.
Nothing on this site is a bid, a quote or an offer to perform work. Work is performed only under a signed written agreement. Where the site and a signed agreement differ, the signed agreement controls.
Accounts and access
Portal accounts are issued by us. You are responsible for keeping your login secure and for activity under your account. Do not share your account with anyone else. Tell us promptly if you believe your account has been used without your permission.
We may suspend or remove access to the portal at any time, including when a project ends or a business relationship changes.
Acceptable use
Do not attempt to access records that do not belong to you, interfere with the operation or security of the site, scrape or bulk-download content, upload malicious files, or use the site for any unlawful purpose.
Content you provide
You keep ownership of the photos, documents and information you upload. You grant us permission to use that material as needed to plan, deliver, document and support your project, and to keep records we are required to keep.
We will not use your project photos in marketing without your permission.
Our content
Text, images, drawings, designs and other material on this site belong to Watermark Design Build or to the parties we license them from, and may not be copied or reused without written permission.
Estimates, schedules and financial information
Figures, dates and progress information shown in the portal reflect the project as of the moment shown and can change. Construction schedules are affected by weather, inspections, permitting, material availability and other conditions outside our control.
Accounting records in our accounting software are the controlling record for amounts billed and received. Where the portal and those accounting records disagree, the accounting records govern and the portal is corrected.
Third-party links and services
The site may link to third-party websites and services, such as lenders or software providers. We do not control them and are not responsible for their content, terms or privacy practices.
Disclaimer and limitation of liability
The site is provided on an as-is basis without warranties of any kind, to the fullest extent permitted by law. We are not liable for indirect, incidental or consequential damages arising from use of the site. Nothing here limits any obligation or warranty set out in a signed construction agreement with us.
Governing law
These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules.
Changes
We may update these terms from time to time. The date at the top of this page shows when they were last changed, and continued use of the site means you accept the updated terms.
